This page combines the website Terms of Use, Community Rules, and Privacy & Cookies Policy for Sia Says (“we,” “us,” “our”). By accessing or using www.siasayscomics.com (the “Site”), you agree to this page.

1) What this Site is

The Site publishes a weekly comic and related content for free. Visitors may be able to use interactive features such as comments and likes.

2) Eligibility

  • You must be at least 13 years old to use interactive features (comments/likes).
  • If you are under the age of majority where you live, you represent that a parent/guardian has consented to your use of the Site.

3) No accounts

The Site does not offer user accounts or registration. If you submit a comment or like content, it is treated as a public interaction as described below.

4) Community Rules (Comments, Likes, and User Content)

You agree not to post, upload, or share any content that:

  • Is unlawful, threatening, harassing, defamatory, hateful, or discriminatory.
  • Is pornographic or sexually explicit involving minors (zero tolerance).
  • Encourages violence, illegal activity, or self-harm.
  • Includes personal data of others without permission (addresses, phone numbers, private IDs).
  • Infringes copyright/trademark or other rights.
  • Contains malware, spam, scams, or deceptive links.
  • Attempts to interfere with the Site (scraping, bots, abuse, bypassing limits).

We may remove content or restrict access to commenting/liking at any time if we believe these rules are violated.

5) Your Content: Permission you give us

“User Content” means anything you submit to the Site (comments, display name if any, etc.).

By submitting User Content, you:

  • Represent you have the rights to submit it.
  • Grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, perform, distribute, and create technical modifications of your User Content only as needed to operate, secure, improve, and promote the Site (e.g., showing your comment, caching, moderation logs, backups, anti-spam systems, sharing a screenshot of a comment for moderation or promotion).

You retain ownership of your User Content.

6) Our Content: Copyright and allowed sharing

All comics, artwork, characters, text, layouts, and Site design elements (collectively “Our Content”) are owned by Johannes Schunter or licensed to us and are protected by copyright and other laws.

You may:

  • Share links to pages on the Site.
  • Use reasonable excerpts as “fair use” where applicable (e.g., brief quotes for review/commentary), with attribution and a link.

You may not (without our written permission):

  • Repost full comic images (or substantial portions), re-host, redistribute, sell, or create merchandise using Our Content.
  • Remove watermarks or copyright notices.
  • Use Our Content in AI training datasets or automated scraping for model training (where prohibited by law/contract), or any bulk extraction of content.

7) Copyright complaints (DMCA-style notice)

If you believe content on the Site infringes your copyright, send a notice to SiaSaysComics@gmail.com with:

  • Your name and contact info.
  • Identification of the copyrighted work.
  • The URL/location of the allegedly infringing content.
  • A statement that you have a good-faith belief the use is unauthorized.
  • A statement, under penalty of perjury, that your notice is accurate and you are the rights holder (or authorized agent).
  • Your physical or electronic signature.

We may remove content and, where appropriate, restrict repeat infringers from using interactive features.

8) Moderation and enforcement

We do not guarantee that all User Content will be reviewed. We may:

  • Remove or edit User Content.
  • Limit or disable comments/likes for any user or region.
  • Cooperate with lawful requests from authorities.

9) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Comments and user posts reflect the views of their authors, not ours. We are not responsible for User Content.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (WHICHEVER IS GREATER). (If you paid nothing, the cap is $100.)

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent permitted.

11) Indemnity

You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses (including reasonable attorney fees) arising from:

  • Your User Content,
  • Your violation of these terms,
  • Your infringement of any rights of another person.

12) Termination

We may suspend or terminate access to interactive features or the Site at any time if we reasonably believe you violated this page or created risk for the Site or others. You may stop using the Site at any time.

  • Backups: 30 days (deleted data may persist in backups up to 30 days)
  • Comments: until the user deletes them or we remove them

Backups may persist for a limited time even after deletion.

  • Correct inaccurate data
  • Delete your data
  • Object to or restrict processing

This page is the entire agreement between you and us regarding the Site, except for any additional policies we may post for specific features.
